Statement by the Indonesian Delegation at the 8th Session of the Working Group on the Universal Periodic Review, Consideration of the UPR Report for Kuwait

Mr President,

 

              I would like to thank the Delegatio of Kuwait, headed by H.E. Dr. Muhammad Muhsin Al-Afasi, Minister of Social Affairs and Labour for their national report. Indonesia would like to commend the progressive nature of the government’s efforts in the promotion and protection of human rights in Kuwait. The 1962 Constitution embodies a full range of human rights principles, making human rights a constitutional mandate.

 

My delegation notes with appreciation that article 29 of the Kuwaiti Constitution states that “All persons have equal human dignity and are equal before the law”. This is particularly relevant and important in dealing with the issue of discrimination against and empowerment of women in the country. Indonesia, therefore, recommends that further progress be achieved in the advancement of the role of Kuwaiti women in the public sphere.

 

Mr. President,

 

Indonesia notes with interest that out of Kuwait’s total population of 3.4 million, 2.3 million are foreign residents representing 180 nationalities. This fact points to the urgent need of ensuring the promotion and protection of the rights of those who constitute almost two-thirds of Kuwait’s population.

 

Indonesia, is encouraged by the Government’s efforts to protect the rights of the workers which has resulted, among others, in improved arrangements relating to employment contracts; a tripartite employment agreement; a regular review of the minimum wage; and the provision of a hotline as part of complaint procedure.

 

Therefore, in a spirit of mutual interest, Indonesia would like to recommend that the Government of Kuwait to take further necessary measures to protect the rights of migrant workers in general, and domestic workers in particular.

 

In conclusion, Mr President, our delegation would like to extend Indonesia’s continuing support to the Government and people of Kuwait in their efforts to promote and protect the human rights both of their nationals and of foreigners living and working in the country.
